"It didn't take much to kill democracy in America..."
I've read some articles claiming that a number of people who are locked up at Gitmo are there because someone in Afghanistan pointed a finger at them for something having nothing to do with terrorism. Maybe it was an old slight or a way to get rid of a business or political rival. But whatever the reason, person A got person B arrested by American troops simply on their say-so and person B has absolutely no way of proving his innocence and being released. I have no idea if that is true but it is certainly plausible. My question is, under the new powers congress is getting ready to hand the president what prevents something similar from happening here? What happens if W decides tomorrow to label Michael Moore an enemy combatant (and don't think there aren't people on the right willing to do so) or a future Democratic president decides to do the same to, say, Ann Coulter? They are taken out of the country, denied habeus proceedings, and prevented from seeing the evidence against them or having access to traditional American courts. Some one construct for me the legal actions that get that person set free. Seriously, this is not a rhetorical question. There are plenty of lawyers and other smart people who read this blog, one of you tell me what course of legal events brings that person home?
And then tell me how this is even thinkable in this once great nation. And also tell me how anyone who claims to be a limited government conservative can even think about letting the president, or anyone for that matter, have that kind of power.

Glad to hear it's back in print. I looked a couple years ago and it wasn't. I still have my old paperback from Dogears Books.
Are you making a distinction between lawyers and smart people?
